1 A bill to be entitled
2 An act relating to employee leasing companies;
3 amending s. 468.525, F.S.; revising requirements
4 relating to employee leasing company contractual
5 arrangements with client companies; amending s.
6 468.535, F.S.; authorizing the Department of Business
7 and Professional Regulation to make investigations,
8 audits, or reviews of an employee leasing company at
9 the request of a client company; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Paragraphs (g), (h), (i), and (j) are added to
15 subsection (4) of section 468.525, Florida Statutes, to read:
16 468.525 License requirements.—
17 (4) The employee leasing company’s contractual arrangements
18 with its client companies shall satisfy the following
19 conditions, whereby the leasing company:
20 (g) Provides all information pertaining to a client
21 company’s business, including, but not limited to, actual
22 coverage under its workers’ compensation policy, loss run
23 history, and actual dates of coverage within 7 days after a
24 request for such information by the client company or the
25 company’s insurance provider.
26 (h) Does not hinder a client company from conducting
27 business or providing employment and placement for employees.
28 (i) Provides notice to, or obtains the consent of, the
29 client company before terminating an employee.
30 (j) Provides the client company with any and all documents
31 requested by the client upon the termination of a client
32 company’s contractual arrangement by the employee leasing
33 company.
34 Section 2. Present subsection (2) of section 468.535,
35 Florida Statutes, is redesignated as subsection (3), and a new
36 subsection (2) is added to that section, to read:
37 468.535 Investigations; audits; review.—
38 (2) The department may make investigations, audits, or
39 reviews of an employee leasing company at the request of a
40 client company.
41 Section 3. This act shall take effect July 1, 2018.
