       Senator Brandes moved the following:
       
    1         Senate Amendment to Amendment (166454) (with title
    2  amendment)

    4         Delete lines 1753 - 1786
    5  and insert:
    6         (g) An amendment to any governing document enacted after
    7  July 1, 2018, that prohibits a parcel owner from renting the
    8  home, alters the authorized duration of a rental term, or
    9  specifies or limits the number of times that a parcel owner may
   10  rent their home during a specified term, applies only to a
   11  parcel owner who acquires title to the home after the effective
   12  date of the amendment or to a parcel owner who consents,
   13  individually or through a representative, to the amendment. For
   14  purposes of this paragraph, a change of ownership does not occur
   15  when a parcel owner conveys the parcel to an affiliated entity
   16  or when beneficial ownership of the parcel does not change. For
   17  purposes of this paragraph, the term “affiliated entity” means
   18  an entity which controls, is controlled by, or is under common
   19  control with the parcel owner or that becomes a parent or
   20  successor entity or an entity under common control, including an
   21  entity that becomes a parent or successor entity of the parcel
   22  owner by reason of transfer, merger, consolidation, public
   23  offering, reorganization, dissolution or sale of stock, or
   24  transfer of membership partnership interests. For a conveyance
   25  to be recognized as one made to an affiliated entity, the entity
   26  must furnish the association a certificate certifying that this
   27  paragraph applies.
