    1                        A bill to be entitled                      
    2         An act relating to mold assessors and mold
    3         remediators; amending s. 468.841, F.S.; authorizing,
    4         upon the declaration of an emergency, an exemption
    5         from mold assessor and mold remediator licensure and
    6         certain regulatory requirements for out-of-state
    7         assessors and remediators for a specified time,
    8         subject to certain conditions; providing an effective
    9         date.
   10          
   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (3) is added to section 468.841,
   14  Florida Statutes, to read:
   15         468.841 Exemptions.—
   16         (3) Upon the declaration of an emergency pursuant to s.
   17  252.36(2), and for 9 months thereafter, a mold assessor or mold
   18  remediator is not required to comply with any provisions of this
   19  part relating to mold assessment or mold remediation, if all of
   20  the following conditions are met:
   21         (a)The mold assessor or mold remediator may only work in
   22  counties that have been directly impacted by the emergency.
   23         (b)The mold assessor or mold remediator is licensed,
   24  incorporated, or registered to do business as a mold assessor or
   25  mold remediator in a state other than this state.
   26         (c)Before engaging in mold assessment or mold remediation,
   27  or holding himself or herself out for hire in this state as a
   28  mold assessor or mold remediator, the mold assessor or mold
   29  remediator must register with the department and provide, at a
   30  minimum, all of the following:
   31         1.The name under which the mold assessor or mold
   32  remediator is doing business in this state.
   33         2.The mold assessor’s or mold remediator’s 24-hour contact
   34  information.
   35         3.A list of the mold assessor’s or mold remediator’s
   36  employees who will be engaged in mold assessment or mold
   37  remediation-related work in this state.
   38         4.Verification that the mold assessor or mold remediator
   39  meets the educational and experience requirements and has passed
   40  a substantially similar examination as required for licensure as
   41  a mold assessor or mold remediator, as appropriate, pursuant to
   42  s. 468.8414.
   43         5.Proof that the mold assessor or mold remediator has an
   44  active liability insurance policy that would cover liability for
   45  mold assessment or mold remediation-related work, as
   46  appropriate, in this state.
   47         Section 2. This act shall take effect July 1, 2018.
