       Senator Garcia moved the following:
       
    1         Senate Amendment (with directory amendment)
    2  
    3         Between lines 134 and 135
    4  insert:
    5         (1) PERSONNEL BACKGROUND CHECKS; REQUIREMENTS AND
    6  EXCEPTIONS.—
    7         (f) Service provider personnel who request an exemption
    8  from disqualification must submit the request within 30 days
    9  after being notified of the disqualification. If 5 years or more
   10  have elapsed since the most recent disqualifying offense,
   11  service provider personnel may work with adults with mental
   12  health or substance use disorders or co-occurring disorders
   13  under the supervision of a qualified professional licensed under
   14  chapter 490 or chapter 491 or a master’s-level-certified
   15  addictions professional until the agency makes a final
   16  determination regarding the request for an exemption from
   17  disqualification.
