Senator Stargel moved the following:
1 Senate Amendment to Amendment (844462) (with title
2 amendment)

4 Between lines 1061 and 1062
5 insert:
6 Section 25. Paragraph (b) of subsection (2) of section
7 202.24, Florida Statutes, is amended to read:
8 202.24 Limitations on local taxes and fees imposed on
9 dealers of communications services.—
10 (2)
11 (b) For purposes of this subsection, a tax, charge, fee, or
12 other imposition includes any amount or in-kind payment of
13 property or services which is required by ordinance or agreement
14 to be paid or furnished to a public body by or through a dealer
15 of communications services in its capacity as a dealer of
16 communications services, regardless of whether such amount or
17 in-kind payment of property or services is:
18 1. Designated as a sales tax, excise tax, subscriber
19 charge, franchise fee, user fee, privilege fee, occupancy fee,
20 rental fee, license fee, pole fee, tower fee, base-station fee,
21 security fund, or other tax or fee;
22 2. Measured by the amounts charged or received for
23 services, regardless of whether such amount is permitted or
24 required to be separately stated on the customer’s bill, by the
25 type or amount of equipment or facilities deployed, or by other
26 means; or
27 3. Intended as compensation for the use of public roads or
28 rights-of-way, for the right to conduct business, or for other
29 purposes.

35 amending s. 202.24, F.S.; adding security funds to a
36 list of certain taxes, charges, fees, or other
37 impositions that public bodies are prohibited from
38 imposing on dealers of communications services by
39 ordinance or agreement;
