       Senator Thurston moved the following:
       
    1         Senate Amendment to Amendment (333236) (with title
    2  amendment)
    3  
    4         Between lines 4 and 5
    5  insert:
    6         Section 1. Paragraph (b) of subsection (3) of section
    7  112.3143, Florida Statutes, is redesignated as paragraph (c),
    8  and a new paragraph (b) is added to that subsection to read:
    9         112.3143 Voting conflicts.—
   10         (3)
   11         (b)Notwithstanding paragraph (a), a public officer of a
   12  county or city commission, council, or board may employ or
   13  contract with a law firm if one or more of the firm’s lawyers
   14  represents a client before the public officer’s commission,
   15  council, or board and the public officer satisfies the following
   16  conditions when a lawyer of the firm appears before the
   17  commission, council, or board:
   18         1.The public officer abstains from voting on any matter in
   19  which the lawyer appears, publicly states the reason for his or
   20  her abstention, and provides a written disclosure, as required
   21  under paragraph (a).
   22         2.The public officer recuses himself or herself from any
   23  questions, discussions, or debate on any such matter.
   24         3.The public officer does not discuss any such matter with
   25  any officer or staff member of the commission, council, or
   26  board.

   28  A public officer who employs or contracts with a law firm and
   29  who fails to satisfy the requirements in this paragraph is
   30  deemed to have violated this subsection.
