2 An act relating to fees; amending s. 383.305, F.S.;
3 providing applicability of licensure fee requirements
4 to advanced birth centers; amending s. 383.324, F.S.;
5 requiring an advanced birth center to pay an
6 inspection fee to the agency; amending s. 408.033,
7 F.S.; providing applicability of an assessment to
8 advanced birth centers; providing a contingent
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 383.305, Florida Statutes, is amended to
14 read:
15 383.305 Licensure; fees.—
16 (1) In accordance with s. 408.805, an applicant for
17 licensure as a birth center or an advanced birth center or a
18 licensee shall pay a fee for each license application submitted
19 under ss. 383.30-383.332 and part II of chapter 408. The amount
20 of the fee shall be established by rule.
21 (2) Each applicant for licensure and each licensee must
22 comply with the requirements of this chapter and part II of
23 chapter 408.
24 Section 2. Section 383.324, Florida Statutes, is amended to
25 read:
26 383.324 Inspections and investigations; inspection fees.
27 Each birth center and advanced birth center facility licensed
28 under s. 383.305 shall pay to the agency an inspection fee
29 established by rule of the agency. In addition to the
30 requirements of part II of chapter 408, the agency shall
31 coordinate all periodic inspections for licensure made by the
32 agency to ensure that the cost to the birth center or advanced
33 birth center facility of such inspections and the disruption of
34 services by such inspections is minimized.
35 Section 3. Paragraph (a) of subsection (2) of section
36 408.033, Florida Statutes, is amended to read:
37 408.033 Local and state health planning.—
38 (2) FUNDING.—
39 (a) The Legislature intends that the cost of local health
40 councils be borne by assessments on selected health care
41 facilities subject to facility licensure by the Agency for
42 Health Care Administration, including abortion clinics, assisted
43 living facilities, ambulatory surgical centers, birth centers,
44 advanced birth centers, home health agencies, hospices,
45 hospitals, intermediate care facilities for the developmentally
46 disabled, nursing homes, health care clinics, and multiphasic
47 testing centers and by assessments on organizations subject to
48 certification by the agency pursuant to chapter 641, part III,
49 including health maintenance organizations and prepaid health
50 clinics. Fees assessed may be collected prospectively at the
51 time of licensure renewal and prorated for the licensure period.
52 Section 4. This act shall take effect on the same date that
53 SB 448 or similar legislation takes effect, if such legislation
54 is adopted in the same legislative session or an extension
55 thereof and becomes a law.
