Senator Harrell moved the following:
1 Senate Amendment to Amendment (799184) (with title
2 amendment)

4 Delete lines 12 - 28
5 and insert:
6 this state may dispense up to a 24-hour supply of a medicinal
7 drug to any patient of, or patient discharged from, an emergency
8 department of a hospital that operates a Class II or Class III
9 institutional pharmacy, provided that the physician who is
10 treating the patient in such hospital’s emergency department, or
11 who is treating the discharged patient, determines that the
12 medicinal drug is warranted and that community pharmacy services
13 are not readily accessible, geographically or otherwise, to the
14 patient. Such prescribing and dispensing from the emergency
15 department must be in accordance with the procedures of the
16 hospital. For any such patient for whom a medicinal drug is
17 warranted for a period to exceed 24 hours, an individual
18 licensed to prescribe such drug must be for the greater of
19 dispense a 24-hour supply of such drug or a supply of such drug
20 which will last the patient until the next business day, to the
21 patient and the prescriber must provide the patient with a
22 prescription for such drug for use after such the initial 24
23 hour period.
