    1                        A bill to be entitled                      
    2         An act relating to the construction industry
    3         workforce; amending s. 468.631, F.S.; requiring that a
    4         specified amount of funds relating to the Building
    5         Code Administrators and Inspectors Fund be allocated
    6         to the University of Florida M.E. Rinker, Sr. School
    7         of Construction Management; authorizing the school to
    8         use the funds for specified purposes; providing an
    9         effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (1) of section 468.631, Florida
   14  Statutes, is amended to read:
   15         468.631 Building Code Administrators and Inspectors Fund.—
   16         (1) This part shall be funded through a surcharge, to be
   17  assessed pursuant to s. 125.56(4) or s. 166.201 at the rate of
   18  1.5 percent of all permit fees associated with enforcement of
   19  the Florida Building Code as defined by the uniform account
   20  criteria and specifically the uniform account code for building
   21  permits adopted for local government financial reporting
   22  pursuant to s. 218.32. The minimum amount collected on any
   23  permit issued shall be $2. The unit of government responsible
   24  for collecting permit fees pursuant to s. 125.56 or s. 166.201
   25  shall collect such surcharge and shall remit the funds to the
   26  department on a quarterly calendar basis beginning not later
   27  than December 31, 2010, for the preceding quarter, and
   28  continuing each third month thereafter; and such unit of
   29  government shall retain 10 percent of the surcharge collected to
   30  fund the participation of building departments in the national
   31  and state building code adoption processes and to provide
   32  education related to enforcement of the Florida Building Code.
   33  There is created within the Professional Regulation Trust Fund a
   34  separate account to be known as the Building Code Administrators
   35  and Inspectors Fund, which shall deposit and disburse funds as
   36  necessary for the implementation of this part.
   37         (a) On a quarterly calendar basis, one quarter of 1 percent
   38  of proceeds from the surcharge shall be distributed to the M.E.
   39  Rinker, Sr. School of Construction Management at the University
   40  of Florida and may be used for the following purposes:
   41         1. Project coordination with institutional partners,
   42  including the Department of Education, Department of Economic
   43  Opportunity, Department of Corrections, and CareerSource
   44  Florida, Inc.
   45         2. Project coordination with the Florida Construction
   46  Workforce Consortium, Inc.
   47         3. Research into construction education issues.
   48         4. Advocacy of construction employment at the K-12 school
   49  levels.
   50         5. Development and maintenance of a Build Your Future
   51  Florida website.
   52         6. Construction careers job fairs.
   53         7. Sponsorship of K-12 after-school activities that focus
   54  on construction careers.
   55         (b) The remaining proceeds from the this surcharge shall be
   56  allocated equally to fund the Florida Homeowners’ Construction
   57  Recovery Fund established by s. 489.140 and the functions of the
   58  Building Code Administrators and Inspectors Board. The
   59  department may transfer excess cash to the Florida Homeowners’
   60  Construction Recovery Fund that it determines is not required to
   61  fund the board from the board’s account within the Professional
   62  Regulation Trust Fund. However, the department may not transfer
   63  excess cash that would exceed the amount appropriated in the
   64  General Appropriations Act, and any amount approved by the
   65  Legislative Budget Commission pursuant to s. 216.181, to be used
   66  for the payment of claims from the Florida Homeowners’
   67  Construction Recovery Fund.
   68         Section 2. This act shall take effect July 1, 2019.
