       The Committee on Rules (Hutson) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 30 - 37
    4  and insert:
    5  this subsection if:
    6         (a) The governing body of a local governmental entity
    7  receives written notice that an ordinance that has been publicly
    8  noticed or adopted is expressly preempted by the State
    9  Constitution or state law; and
   10         (b) The governing body of the local governmental entity
   11  withdraws the ordinance from consideration or repeals the
   12  ordinance within 60 days after receiving such written notice.
