    1                        A bill to be entitled                      
    2         An act relating to motor vehicle racing; amending s.
    3         316.191, F.S.; increasing the criminal penalty for a
    4         third or subsequent violation related to motor vehicle
    5         racing within a specified period after the date of a
    6         prior violation that resulted in a conviction;
    7         providing an effective date.
    8          
    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (2) and paragraph (c) of subsection
   12  (3) of section 316.191, Florida Statutes, are amended to read:
   13         316.191 Racing on highways.—
   14         (2) A person may not do any of the following:
   15         (a) Drive any motor vehicle, including any motorcycle, in
   16  any race, speed competition or contest, drag race or
   17  acceleration contest, test of physical endurance, or exhibition
   18  of speed or acceleration or for the purpose of making a speed
   19  record on any highway, roadway, or parking lot.;
   20         (b) In any manner participate in, coordinate, facilitate,
   21  or collect moneys at any location for any such race,
   22  competition, contest, test, or exhibition.;
   23         (c) Knowingly ride as a passenger in any such race,
   24  competition, contest, test, or exhibition.; or
   25         (d) Purposefully cause the movement of traffic to slow or
   26  stop for any such race, competition, contest, test, or
   27  exhibition.

   29         (c) Any person who commits a third or subsequent violation
   30  of subsection (2) within 5 years after the date of a prior
   31  violation that resulted in a conviction for a violation of
   32  subsection (2) commits a felony of the third misdemeanor of the
   33  first degree, punishable as provided in s. 775.082, or s.
   34  775.083, or s. 775.084, and shall pay a fine of not less than
   35  $2,000 and not more than $5,000. The department shall also
   36  revoke the driver license of that person for 4 years. A hearing
   37  may be requested pursuant to s. 322.271.
   38         Section 2. This act shall take effect October 1, 2019.
