       Senator Harrell moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 235 - 246
    4  and insert:
    5  provider, as defined in s. 456.47, must be a voluntary contract
    6  between the insurer and the provider, must establish mutually
    7  acceptable payment rates or payment methodologies for services
    8  provided through telehealth, and must give the provider the
    9  option to accept a reimbursement for a covered service provided
   10  through telehealth in an amount less than the reimbursement the
   11  insurer would pay if the service were delivered through an in
   12  person encounter.
   13         Section 3. Effective January 1, 2020, subsection (45) is
   14  added to section 641.31, Florida Statutes, to read:
   15         641.31 Health maintenance contracts.—
   16         (45) A contract between a health maintenance organization
   17  issuing major medical individual or group coverage and a
   18  telehealth provider, as defined in s. 456.47, must be a
   19  voluntary contract between the health maintenance organization
   20  and the provider, must establish mutually acceptable payment
   21  rates or payment methodologies for services provided through
   22  telehealth, and must give the provider the option to accept a
   23  reimbursement for a covered service provided through telehealth
   24  in an amount less than the reimbursement the

   27  And the title is amended as follows:
   28         Delete lines 23 - 32
   29  and insert:
   30         adopt rules; creating s. 627.42396, F.S.; providing
   31         requirements for a contract between a certain health
   32         insurer and a telehealth provider; amending s. 641.31,
   33         F.S.; providing requirements for a contract between a
   34         certain health maintenance organization and a
   35         telehealth provider; requiring the department to
