    2         An act relating to driver license, identification
    3         card, and motor vehicle registration applications;
    4         amending s. 320.02, F.S.; deleting a requirement that
    5         the application form for motor vehicle registration
    6         and renewal of registration include language
    7         permitting a voluntary contribution to the Auto Club
    8         Group Traffic Safety Foundation; requiring that such
    9         application form include language permitting a
   10         voluntary contribution to the Live Like Bella
   11         Childhood Cancer Foundation; requiring that the
   12         Department of Highway Safety and Motor Vehicles
   13         distribute such contributions to the Live Like Bella
   14         Childhood Cancer Foundation; amending s. 322.08, F.S.,
   15         deleting a requirement that the application form for a
   16         driver license or identification card include language
   17         permitting a voluntary contribution to the Auto Club
   18         Group Traffic Safety Foundation; providing an
   19         effective date.

   21  Be It Enacted by the Legislature of the State of Florida:
   22  
   23         Section 1. Paragraph (t) of subsection (16) of section
   24  320.02, Florida Statutes, is amended, present paragraph (u) of
   25  that subsection is redesignated as paragraph (t), and a new
   26  paragraph (u) is added to that subsection, to read:
   27         320.02 Registration required; application for registration;
   28  forms.—
   29         (16)
   30         (t) The application form for motor vehicle registration and
   31  renewal registration must include language permitting a
   32  voluntary contribution of $1 or more per applicant, which shall
   33  be distributed to the Auto Club Group Traffic Safety Foundation,
   34  Inc., a nonprofit organization. Funds received by the foundation
   35  must be used to improve traffic safety culture in communities
   36  through effective outreach, education, and activities in the
   37  state which will save lives, reduce injuries, and prevent
   38  crashes. The foundation must comply with s. 320.023.
   39         (u) Notwithstanding s. 320.023(1) and (2), the application
   40  form for motor vehicle registration and renewal of registration
   41  must include language permitting a voluntary contribution of $1
   42  or more per applicant to the Live Like Bella Childhood Cancer
   43  Foundation. Such contributions must be distributed by the
   44  department to the Live Like Bella Childhood Cancer Foundation.

   46  For the purpose of applying the service charge provided in s.
   47  215.20, contributions received under this subsection are not
   48  income of a revenue nature.
   49         Section 2. Paragraph (r) of subsection (8) of section
   50  322.08, Florida Statutes, is amended, and present paragraphs (s)
   51  and (t) of that subsection are redesignated as paragraphs (r)
   52  and (s), respectively, to read:
   53         322.08 Application for license; requirements for license
   54  and identification card forms.—
   55         (8) The application form for an original, renewal, or
   56  replacement driver license or identification card must include
   57  language permitting the following:
   58         (r) A voluntary contribution of $1 or more per applicant,
   59  which shall be distributed to the Auto Club Group Traffic Safety
   60  Foundation, Inc., a not-for-profit organization.
   61  
   62  A statement providing an explanation of the purpose of the trust
   63  funds shall also be included. For the purpose of applying the
   64  service charge provided under s. 215.20, contributions received
   65  under paragraphs (b)-(s) (b)-(t) are not income of a revenue
   66  nature.
   67         Section 3. This act shall take effect July 1, 2019.
