       Senator Rader moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Before line 12
    4  insert:
    5         Section 1. Subsection (4) of section 627.714, Florida
    6  Statutes, is amended to read:
    7         627.714 Residential condominium unit owner coverage; loss
    8  assessment coverage required.—
    9         (4) Every individual unit owner’s residential property
   10  policy must contain a provision stating that the coverage
   11  afforded by such policy is excess coverage over the amount
   12  recoverable under any other policy covering the same property.
   13  If a condominium association’s insurance policy for the
   14  association does not provide rights for subrogation against the
   15  unit owners in the association, an insurance policy issued to an
   16  individual unit owner located in the association may not provide
   17  rights of subrogation against the condominium association.

   20  And the title is amended as follows:
   21         Delete lines 2 - 3
   22  and insert:
   23         An act relating to residential property insurance
   24         policies; amending s. 627.714, F.S.; providing that a
   25         residential condominium unit owner’s property
   26         insurance policy may not provide rights of subrogation
   27         against the condominium association under certain
   28         circumstances; amending s. 627.7011, F.S.; revising
