Senator Rodriguez moved the following:

3 Between lines 803 and 804
4 insert:
5 Section 5. Subsection (1) of section 40.013, Florida
6 Statutes, is amended to read:
7 40.013 Persons disqualified or excused from jury service.—
8 (1) No person who is under prosecution for any crime, or
9 who has been convicted in this state, any federal court, or any
10 other state, territory, or country of bribery, forgery, perjury,
11 larceny, or any other offense that is a felony in this state or
12 which if it had been committed in this state would be a felony,
13 unless restored to civil rights, shall be qualified to serve as
14 a juror. However, the disqualification provided under this
15 subsection no longer applies upon the restoration of voting
16 rights pursuant to s. 4., Art. VI of the State Constitution and
17 s. 98.0751 for a person who has completed all terms of sentence
18 for a felony conviction for an offense other than murder or a
19 felony sexual offense.
20 Section 6. If any provision of this act or an act passed by
21 the Legislature relating to the implementation of s. 4, Article
22 VI of the State Constitution is held to be invalid, the
23 invalidity does not affect the provisions of this act which can
24 be given effect without the invalid provision or application,
25 and to this end this act is severable.
