The Committee on Agriculture (Broxson) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 33 - 35
4 and insert:
5 377.2405 Well stimulation.—All of the following are
6 prohibited in this state:
7 (1) Fracking. A permit for drilling or operating a well
8 does not authorize fracking.
9 (2)(a) For wells that are drilled to a depth of greater
10 than 15 feet below land surface, the use of acid to dissolve
11 carbonate formations in the form of rock matrix, drill cuttings,
12 or encrusted or deposited layers in or near a wellbore.
13 (b) The use of acids, including, but not limited to,
14 hydrochloric acid, hydrofluoric acid, muriatic acid, glycolic
15 acid, phosphoric acid, sulfamic acid, acetic acid, citric acid,
16 hydroxyacetic acid, and oxalic acid, which have an acid
17 concentration of more than 5 percent in wells for the production
18 or stimulation of fluid flow including fresh water, saltwater,
19 or crude oil.

22 And the title is amended as follows:
23 Delete lines 2 - 6
24 and insert:
25 An act relating to well stimulation; amending s.
26 377.19, F.S.; defining the term “fracking”; creating
27 s. 377.2405, F.S.; prohibiting fracking in this state;
28 providing that permits for drilling or operating a
29 well do not authorize fracking; prohibiting the use of
30 acid in certain wells to dissolve carbonate formations
31 in or near a wellbore in this state; prohibiting the
32 use of acids in a concentration greater than a
33 specified percentage in all wells for a specified
34 purpose; providing an effective date.
