       Senator Pizzo moved the following:
       
    1         Senate Amendment to Amendment (458014) 
    2  
    3         Delete lines 287 - 317
    4  and insert:
    5  monitored by the Department of Corrections; and
    6         5.a.Full payment of restitution ordered to a victim by the
    7  court as a part of the sentence. A victim includes, but is not
    8  limited to, a person or persons, the estate or estates thereof,
    9  an entity, the state, or the Federal Government.
   10         b. Full payment of fines or fees ordered as a part of the
   11  sentence or that are ordered by the court as a condition of any
   12  form of supervision, including, but not limited to, probation,
   13  community control, or parole.
   14         c.The financial obligations required under sub
   15  subparagraph a. or sub-subparagraph b. include only the amount
   16  specifically ordered by the court as part of the sentence and do
   17  not include any fines, fees, or costs that accrue after the date
   18  the obligation is ordered as a part of the sentence.
   19         d. Financial obligations required under sub-subparagraph a.
   20  or sub-subparagraph b. are considered completed in the following
   21  manner or in any combination thereof:
   22         (I)Actual payment of the obligation in full.
   23         (II) Upon the payee’s approval, the termination by the
   24  court of any financial obligation to a payee, including, but not
   25  limited to, a victim, or the court.
   26         (III) Completion of all community service hours, if the
   27  court, unless otherwise prohibited by law or the State
   28  Constitution, converts the financial obligation to community
   29  service.

   31  A term required to be completed in accordance with this
   32  paragraph shall be deemed completed if the court modifies the
   33  original sentencing order to no longer require completion of
   34  such term. Any fine or fee that is not modified by the court
   35  shall be deemed waived.
