       The Committee on Appropriations (Bean) recommended the
       following:
       
    1         Senate Amendment (with title amendment)

    4  insert:
    5         Section 20. Section 768.094, Florida Statutes, is created
    6  to read:
    7         768.094 Roller skating rinks; operator and roller skater
    8  responsibilities.—
    9         (1)LEGISLATIVE FINDINGS AND INTENT.The Legislature finds
   10  that the recreational sport of roller skating is practiced by a
   11  large number of citizens in this state and is a wholesome and
   12  healthy family activity. The Legislature further finds that
   13  owners of roller skating rinks have great difficulty in
   14  obtaining liability insurance coverage at an affordable cost and
   15  that the lack of affordable insurance coverage affects not only
   16  the owners, but also patrons who may suffer personal injury as a
   17  result of accidents that occur on the premises of a roller
   18  skating rink. In order to make it more economically feasible for
   19  insurance companies to provide affordable coverage to owners,
   20  this section establishes standards to provide more
   21  predictability in liability to the owners of rinks and that
   22  encourage risk reduction techniques.
   23         (2)DEFINITIONS.As used in this section, the term:
   24         (a)Operator” means a person or an entity that owns,
   25  manages, controls, directs, or has operational responsibility
   26  for a roller skating rink.
   27         (b)Roller skater” means a person wearing roller skates
   28  while in a roller skating rink for the purpose of recreational
   29  or competitive roller skating. The term includes an individual
   30  in a roller skating rink who is an invitee, regardless of
   31  whether the person pays consideration.
   32         (c)Roller skating rink” means a building, a facility, or
   33  a premises that provides an area specifically designed to be
   34  used by the public for recreational or competitive roller
   35  skating.
   36         (d)Spectator” means a person who is present in a roller
   37  skating rink only for the purpose of observing recreational or
   38  competitive roller skating.
   39         (3)OPERATOR RESPONSIBILITIES.An operator shall:
   40         (a)Comply with all current roller skating rink safety
   41  standards published by the Roller Skating Association
   42  International to the extent such standards are consistent with
   43  this section.
   44         (b)Post the duties of roller skaters and spectators and
   45  the duties and obligations of the operator, as prescribed in
   46  this section, in at least three conspicuous locations in the
   47  roller skating rink.
   48         (c)Maintain the stability and legibility of all signs,
   49  symbols, and posted notices required by this section.
   50         (d)When the skating rink is open for skating sessions,
   51  have as least one floor supervisor on duty for every 200 roller
   52  skaters.
   53         (e)Maintain the skating surface in a reasonably safe
   54  condition, and clean and inspect the skating surface before each
   55  skating session.
   56         (f)Maintain in good condition the railings, kickboards,
   57  and walls surrounding the skating surface.
   58         (g)In rinks with step-up or step-down skating surfaces,
   59  ensure that the covering on the riser is securely fastened.
   60         (h)Install fire extinguishers and inspect them at
   61  recommended intervals.
   62         (i)Inspect emergency lighting units at least quarterly to
   63  ensure that they are in proper working order.
   64         (j)Keep exit lights and lights in service areas on when
   65  skating surface lights are turned off during a skating session.
   66         (k)Maintain in good mechanical condition roller skating
   67  equipment that the operator leases or rents to roller skaters.
   68         (l)Comply with all applicable state and local safety
   69  codes.
   70         (4)ROLLER SKATER RESPONSIBILITIES.—A roller skater shall:
   71         (a)Maintain reasonable control of his or her speed and the
   72  course at all times.
   73         (b)Heed all posted signs and warnings.
   74         (c)Maintain a proper outlook to avoid other roller skaters
   75  and objects.
   76         (d)Accept the responsibility for knowing the range of his
   77  or her own ability to negotiate the intended direction of travel
   78  while on roller skates and to skate within the limits of that
   79  ability.
   80         (e)Refrain from acting in a manner that may cause or
   81  contribute to the injury of the roller skater or any other
   82  person.
