The Committee on Judiciary (Stargel) recommended the following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Subsection (8) is added to section 57.105,
6 Florida Statutes, to read:
7 57.105 Attorney’s fee; sanctions for raising unsupported
8 claims or defenses; exceptions; service of motions; damages for
9 delay of litigation.—
10 (8) Attorney fees may not be awarded under this section
11 pursuant to s. 784.046, unless the court finds by clear and
12 convincing evidence that the petitioner knowingly made a false
13 statement or allegation in the petition in regard to a material
14 matter as defined in s. 837.011(3).
15 Section 2. This act shall take effect July 1, 2019.

21 A bill to be entitled
22 An act relating to attorney fees; amending s. 57.105,
23 F.S.; prohibiting the awarding of attorney fees for a

25 exception; providing an effective date.
