2 An act relating to the duty to assist; amending s.
3 768.13, F.S.; requiring certain persons under
4 specified circumstances to provide reasonable
5 assistance to another person who is exposed to or has
6 suffered serious bodily injury; defining terms;
7 providing penalties; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (3) of section 768.13, Florida
12 Statutes, is renumbered as subsection (4), and a new subsection
13 (3) is added to that section, to read:
14 768.13 Good Samaritan Act; immunity from civil liability.—
15 (3) Notwithstanding subsection (2), a person who is at the
16 scene of an emergency and who knows that another person is
17 exposed to or has suffered serious bodily injury shall, to the
18 extent that he or she can do so without causing danger or peril
19 to oneself or others, provide reasonable assistance to the
20 exposed or injured person. Reasonable assistance includes
21 contacting, obtaining, or attempting to contact or obtain aid
22 from law enforcement or medical personnel. For purposes of this
23 subsection, the term “serious bodily injury” has the same
24 meaning as provided in s. 790.155. A person who violates this
25 subsection commits a misdemeanor of the second degree,
26 punishable as provided in s. 775.082 or s. 775.083.
27 Section 2. This act shall take effect October 1, 2019.
