    1                        A bill to be entitled                      
    2         An act relating to natural hair braiding; amending s.
    3         477.013, F.S.; redefining the term “hair braiding”;
    4         defining the term “mechanical devices”; amending ss.
    5         477.0132 and 477.019, F.S.; conforming provisions to
    6         changes made by the act; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Subsections (9) and (10) of section 477.013,
   11  Florida Statutes, are amended to read:
   12         477.013 Definitions.—As used in this chapter:
   13         (10)(9) “Natural hair braiding” means the braiding,
   14  extending, locking, twisting, wrapping, or weaving or
   15  interweaving of natural human hair by hand or by use of
   16  mechanical devices for compensation without cutting, coloring,
   17  permanent waving, relaxing, removing, or chemical treatment and
   18  does not include the use of hair extensions or wefts.
   19         (a) The term includes, when such acts are incidental to the
   20  braiding, extending, locking, twisting, wrapping, or weaving of
   21  the hair, the use of natural or synthetic hair extensions,
   22  natural or synthetic hair and fibers, decorative beads, and
   23  other hair accessories and the minor trimming of natural hair or
   24  hair extensions.
   25         (b) The term is not limited to any particular cultural,
   26  ethnic, racial, or religious hair style and does not include the
   27  application of dyes, reactive chemicals, or other preparations
   28  to alter the color of the hair or to straighten, curl, or alter
   29  the structure of the hair; or the use of chemical hair joining
   30  agents, such as synthetic tape, keratin bonds, or fusion bonds.
   31         (c) As used in this subsection, the term “mechanical
   32  devices” means clips, combs, crochet hooks, hairpins, scissors,
   33  needles, thread, and hair binders.
   34         (9)(10) “Hair wrapping” means the wrapping of manufactured
   35  materials around a strand or strands of human hair, for
   36  compensation, without cutting, coloring, permanent waving,
   37  relaxing, removing, weaving, chemically treating, braiding,
   38  using hair extensions, or performing any other service defined
   39  as cosmetology.
   40         Section 2. Section 477.0132, Florida Statutes, is amended
   41  to read:
   42         477.0132 Natural hair braiding, hair wrapping, and body
   43  wrapping registration.—
   44         (1)(a) Persons whose occupation or practice is confined
   45  solely to natural hair braiding must register with the
   46  department, pay the applicable registration fee, and take a two
   47  day 16-hour course. The course shall be board approved and
   48  consist of 5 hours of HIV/AIDS and other communicable diseases,
   49  5 hours of sanitation and sterilization, 4 hours of disorders
   50  and diseases of the scalp, and 2 hours of studies regarding laws
   51  affecting natural hair braiding.
   52         (b) Persons whose occupation or practice is confined solely
   53  to hair wrapping must register with the department, pay the
   54  applicable registration fee, and take a one-day 6-hour course.
   55  The course shall be board approved and consist of education in
   56  HIV/AIDS and other communicable diseases, sanitation and
   57  sterilization, disorders and diseases of the scalp, and studies
   58  regarding laws affecting hair wrapping.
   59         (c) Unless otherwise licensed or exempted from licensure
   60  under this chapter, any person whose occupation or practice is
   61  body wrapping must register with the department, pay the
   62  applicable registration fee, and take a two-day 12-hour course.
   63  The course shall be board approved and consist of education in
   64  HIV/AIDS and other communicable diseases, sanitation and
   65  sterilization, disorders and diseases of the skin, and studies
   66  regarding laws affecting body wrapping.
   67         (d) Only the board may review, evaluate, and approve a
   68  course required of an applicant for registration under this
   69  subsection in the occupation or practice of natural hair
   70  braiding, hair wrapping, or body wrapping. A provider of such a
   71  course is not required to hold a license under chapter 1005.
   72         (2) Natural hair braiding, hair wrapping, and body wrapping
   73  are not required to be practiced in a cosmetology salon or
   74  specialty salon. When natural hair braiding, hair wrapping, or
   75  body wrapping is practiced outside a cosmetology salon or
   76  specialty salon, disposable implements must be used or all
   77  implements must be sanitized in a disinfectant approved for
   78  hospital use or approved by the federal Environmental Protection
   79  Agency.
   80         (3) Pending issuance of registration, a person is eligible
   81  to practice natural hair braiding, hair wrapping, or body
   82  wrapping upon submission of a registration application that
   83  includes proof of successful completion of the education
   84  requirements and payment of the applicable fees required by this
   85  chapter.
   86         Section 3. Paragraph (b) of subsection (7) of section
   87  477.019, Florida Statutes, is amended to read:
   88         477.019 Cosmetologists; qualifications; licensure;
   89  supervised practice; license renewal; endorsement; continuing
   90  education.—
   91         (7)
   92         (b) Any person whose occupation or practice is confined
   93  solely to natural hair braiding, hair wrapping, or body wrapping
   94  is exempt from the continuing education requirements of this
   95  subsection.
   96         Section 4. This act shall take effect July 1, 2019.
