Florida Senate - 2019 CS for SB 882 By the Committee on Commerce and Tourism; and Senator Gruters 577-04030-19 2019882c1 1 A bill to be entitled 2 An act relating to restrictive covenants; creating s. 3 542.336, F.S.; providing that certain restrictive 4 covenants are void and unenforceable for a specified 5 period; providing an effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1. Section 542.336, Florida Statutes, is created to 10 read: 11 542.336 Invalid restrictive covenants.—A restrictive 12 covenant entered into with a physician licensed under chapter 13 458 or chapter 459 who practices a medical specialty in a county 14 where one entity employs or contracts with, either directly or 15 through related or affiliated entities, all physicians who 16 practice such specialty in that county is not supported by a 17 legitimate business interest and is void and unenforceable. Such 18 restrictive covenant shall remain void and unenforceable for 3 19 years after the date on which a second entity that employs or 20 contracts with, either directly or through related or affiliated 21 entities, one or more physicians who practice such specialty 22 begins serving patients in that county. 23 Section 2. This act shall take effect July 1, 2019.
