    2         An act relating to the Statewide Medicaid Residency
    3         Program; amending s. 409.909, F.S.; revising the
    4         definition of the term “qualifying institution” to
    5         include certain community facilities and community
    6         mental health centers or clinics; providing an
    7         effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (c) of subsection (2) of section
   12  409.909, Florida Statutes, is amended to read:
   13         409.909 Statewide Medicaid Residency Program.—
   14         (2) On or before September 15 of each year, the agency
   15  shall calculate an allocation fraction to be used for
   16  distributing funds to participating hospitals and to qualifying
   17  institutions as defined in paragraph (c). On or before the final
   18  business day of each quarter of a state fiscal year, the agency
   19  shall distribute to each participating hospital one-fourth of
   20  that hospital’s annual allocation calculated under subsection
   21  (4). The allocation fraction for each participating hospital is
   22  based on the hospital’s number of full-time equivalent residents
   23  and the amount of its Medicaid payments. As used in this
   24  section, the term:
   25         (c) “Qualifying institution” means a federally qualified
   26  health center, a community facility as defined in s. 394.455(8),
   27  or a community mental health center or clinic as defined in s.
   28  394.455(9), which holds holding an Accreditation Council for
   29  Graduate Medical Education institutional accreditation.
   30         Section 2. This act shall take effect July 1, 2019.
