       Senator Brandes moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 32 - 52
    4  and insert:
    5  clothing-optional or naturalist beach; or
    6         (c) An inmate incarcerated at a state correctional
    7  institution or local detention facility does not under any
    8  circumstance violate this section.
    9         Section 2. By September 1, 2020, the Division of State
   10  Parks of the Department of Environmental Protection and the
   11  Florida Tourism Industry Marketing Corporation shall jointly
   12  hold a public hearing to consider options to expand clothing
   13  optional or naturalist beaches in this state. By October 1,
   14  2020, the division shall amend rule 62D-2.014(7)(b), Florida
   15  Administrative Code, to comply with this act.
   16         Section 3. Subsection (9) of section 901.15, Florida
   17  Statutes, is amended to read
   18         901.15 When arrest by officer without warrant is lawful.—A
   19  law enforcement officer may arrest a person without a warrant
   20  when:
   21         (9) There is probable cause to believe that the person has
   22  committed:
   23         (a) Any battery upon another person, as defined in s.
   24  784.03.
   25         (b) An act of criminal mischief or a graffiti-related
   26  offense as described in s. 806.13.
   27         (c) A violation of a safety zone, security zone, regulated
   28  navigation area, or naval vessel protection zone as described in
   29  s. 327.461.
   30         (d) A racing violation as described in s. 316.191(2).
   31         (e) An exposure of sexual organs in violation of s. 800.03.
   32         Section 4. Except as otherwise expressly provided in this
   33  act and except for this section, which shall take effect July 1,
   34  2020, this act shall take effect October 1, 2020.

   38         Delete lines 5 - 9
   39  and insert:
   40         providing exceptions to the unlawful exposure of
   41         sexual organs; requiring the Division of State Parks
   42         of the Department of Environmental Protection and the
   43         Florida Tourism Industry Marketing Corporation to
   44         jointly hold a public hearing by a specified date to
   45         consider options to expand clothing-optional or
   46         naturalist beaches; requiring the division to amend a
   47         certain rule by a specified date; amending s. 901.15,
   48         F.S.; authorizing warrantless arrests when a law
   49         enforcement officer has probable cause to believe that
   50         a person has violated s. 800.03, F.S.; providing
   51         effective dates.
