2 An act relating to fire prevention and control;
3 creating s. 633.137, F.S.; creating the Firefighter
4 Cancer Decontamination Equipment Grant Program within
5 the Division of State Fire Marshal of the Department
6 of Financial Services for certain purposes; requiring
7 the division to administer the program and annually
8 award grants, and distribute equipment and training,
9 to qualifying fire departments in a certain manner;
10 requiring the State Fire Marshal to adopt rules and
11 procedures; providing application criteria; providing
12 requirements for grant recipients; amending s.
13 191.006, F.S.; providing that an independent special
14 fire control district has, and that the board of such
15 district may exercise by majority vote, specified
16 powers; providing an appropriation; providing an
17 effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Section 633.137, Florida Statutes, is created to
22 read:
23 633.137 Firefighter Cancer Decontamination Equipment Grant
24 Program.—
25 (1) The Firefighter Cancer Decontamination Equipment Grant
26 Program is created within the division to help protect the
27 health and safety of firefighters in this state. The program
28 shall provide financial assistance to help fire departments,
29 including volunteer fire departments, procure equipment,
30 supplies, and educational training designed to mitigate exposure
31 to hazardous, cancer-causing chemicals.
32 (2) The division shall administer the program and annually
33 award grants to fire departments on a need-based basis. The
34 division shall distribute equipment and training in a manner
35 that leads to the greatest reduction in incidences of
36 firefighters being exposed to hazardous post-fire contaminants.
37 (3) The State Fire Marshal shall adopt rules and procedures
38 for the program, including for the approval of applications and
39 development of need-based criteria. This criteria shall include,
40 but are not limited to, the decontamination equipment and supply
41 needs of the fire department, the financial needs of the fire
42 department, and the level of nonstate matching funds proposed in
43 the application. Grant applications must include a minimum of 25
44 percent nonstate funding.
45 (4) Grant recipients must:
46 (a) Report their activity to the division for submission in
47 the Fire and Emergency Incident Information Reporting System
48 created under s. 633.136.
49 (b) Comply with the Florida Firefighters Occupational
50 Safety and Health Act, ss. 633.502-633.536.
51 (c) Comply with any other rule determined by the State Fire
52 Marshal to effectively and efficiently implement, administer,
53 and manage the program.
54 Section 2. Subsection (13) of section 191.006, Florida
55 Statutes, is amended to read:
56 191.006 General powers.—The district shall have, and the
57 board may exercise by majority vote, the following powers:
58 (13) To cooperate or contract with other persons or
59 entities, including other governmental agencies, as necessary,
60 convenient, incidental, or proper in connection with providing
61 effective mutual aid and furthering any power, duty, or purpose
62 authorized by this act. The district has, and the board may
63 exercise, all powers and duties provided in s. 163.01, chapter
64 189, and this chapter, including such powers within or without
65 the district’s boundary, in cooperation with another
66 governmental agency when such agency shares such powers in
67 common with the district.
68 Section 3. For the 2020-2021 fiscal year, the sum of
69 $250,000 in recurring funds is appropriated from the Insurance
70 Regulatory Trust Fund to the Department of Financial Services
71 for the purpose of implementing s. 633.137, Florida Statutes, as
72 created by this act.
73 Section 4. This act shall take effect July 1, 2020.
