    1                        A bill to be entitled                      
    2         An act relating to emergency telecommunication devices
    3         in public swimming pools; creating s. 514.0316, F.S.;
    4         authorizing public swimming pools to be equipped with
    5         continuously accessible emergency telecommunication
    6         devices; providing that an owner of a public swimming
    7         pool who elects to install such device must comply
    8         with certain requirements by a specified date;
    9         providing that property on which a public swimming
   10         pool is equipped with an emergency telecommunication
   11         device is eligible for certain adjustments or
   12         reductions in general liability insurance policy
   13         rates; providing an effective date.
   14          
   15  Be It Enacted by the Legislature of the State of Florida:
   16  
   17         Section 1. Section 514.0316, Florida Statutes, is created
   18  to read:
   19         514.0316 Emergency telecommunication devices in public
   20  swimming pools.—
   21         (1)To ensure public safety and reduce the risk of
   22  drownings, a public swimming pool may be equipped with an
   23  emergency telecommunication device that is capable of directly
   24  communicating with a public or private emergency notification
   25  service and that is continuously accessible to all public
   26  swimming pool users. If the owner of a public swimming pool
   27  elects to equip the public swimming pool with an emergency
   28  telecommunication device, the owner must comply with all of the
   29  following requirements by the compliance date set by the local
   30  health department or December 31, 2020, whichever date is
   31  earlier:
   32         (a)The device must be permanently mounted inside the pool
   33  enclosure, or outside the enclosure but within 75 feet of a
   34  bather entrance, and includes dialing instructions.
   35         (b)The device must be visible from inside the pool
   36  enclosure or, if mounted outside the pool enclosure, a sign must
   37  be posted inside the enclosure indicating the location of the
   38  device.
   39         (2)Property containing a public swimming pool that is
   40  equipped with an emergency telecommunication device in
   41  compliance with paragraph (1)(a) is eligible for any adjustments
   42  or discounts to general liability insurance policy rates under
   43  s. 627.062 which are associated with the reduction of drownings
   44  or the reduction of swimming pool accidents and drownings.
   45         Section 2. This act shall take effect July 1, 2020.
