       The Committee on Rules (Simmons) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 71 - 95
    4  and insert:
    5         (a) The regulation of public lodging establishments and
    6  public food service establishments, including, but not limited
    7  to, sanitation standards, inspections, training and testing of
    8  personnel, and matters related to the nutritional content and
    9  marketing of foods offered in such establishments, is preempted
   10  to the state. This paragraph does not preempt the authority of a
   11  local government or local enforcement district to conduct
   12  inspections of public lodging and public food service
   13  establishments for compliance with the Florida Building Code and
   14  the Florida Fire Prevention Code, pursuant to ss. 553.80 and
   15  633.206.
   16         (b) A local law, ordinance, or regulation may not prohibit
   17  vacation rentals or regulate the duration or frequency of rental
   18  of vacation rentals. This paragraph does not apply to any local
