       Senator Thurston moved the following:
       
    1         Senate Amendment to Amendment (464008) 
    2  
    3         Delete lines 1104 - 1121
    4  and insert:
    5         (101) DIVINE NINE LICENSE PLATES.—
    6         (a) The department shall develop a Divine Nine license
    7  plate as provided in this section and s. 320.08053 using a
    8  standard template and a unique logo, graphic, or color for each
    9  of the organizations listed in sub-subparagraphs (b)2.a.-i. The
   10  plate must bear the colors and design approved by the
   11  department, and must include the official logo, graphic, or
   12  color as appropriate for each organization. The word “Florida”
   13  must appear at the top of the plate, and the words “Divine Nine
   14  must appear at the bottom of the plate.
   15         (b) The annual use fees from the sale of the plate shall be
   16  distributed as follows:
   17         1. Five percent of the proceeds shall be distributed to the
   18  United Negro College Fund, Inc., for college scholarships for
   19  Florida residents attending Florida’s historically black
   20  colleges and universities.
   21         2. The remaining 95 percent of the proceeds shall be
   22  distributed to one of the following organizations as selected by
   23  the purchaser of the plate who shall receive a license plate
   24  with the logo, graphic, or color associated with the appropriate
   25  recipient organization:
   26         a. Alpha Phi Alpha Fraternity, Inc.
   27         (I) Eighty-five percent shall be distributed to the Florida
   28  Federation of Alpha Chapters, Inc., to promote community
   29  awareness and action through educational, economic, and cultural
   30  service activities within this state.
   31         (II) Ten percent shall be distributed to the Florida
   32  Federation of Alpha Chapters, Inc., solely for the marketing of
   33  the plate.
   34         b. Alpha Kappa Alpha Sorority, Inc.
   35         (I) Eighty-five percent shall be distributed to the Alpha
   36  Kappa Alpha Educational Advancement Foundation, Inc., to promote
   37  community awareness and action through educational, economic,
   38  and cultural service activities within this state.
   39         (II) Ten percent shall be distributed to the Alpha Kappa
   40  Alpha Educational Advancement Foundation, Inc., solely for the
   41  marketing of the plate.
   42         c. Kappa Alpha Psi Fraternity, Inc.
   43         (I) Eighty-five percent shall be distributed to the
   44  Southern Province of Kappa Alpha Psi Fraternity, Inc., to
   45  promote community awareness and action through educational,
   46  economic, and cultural service activities within this state.
   47         (II) Ten percent shall be distributed to the Southern
   48  Province of Kappa Alpha Psi Fraternity, Inc., solely for the
   49  marketing of the plate.
   50         d. Omega Psi Phi Fraternity, Inc.
   51         (I) Eighty-five percent shall be distributed to the State
   52  of Florida Omega Friendship Foundation, Inc., to promote
   53  community awareness and action through educational, economic,
   54  and cultural service activities within this state.
   55         (II) Ten percent shall be distributed to the State of
   56  Florida Omega Friendship Foundation, Inc., solely for the
   57  marketing of the plate.
   58         e. Delta Sigma Theta Sorority, Inc.
   59         (I) Eighty-five percent shall be distributed to the Delta
   60  Research and Educational Foundation, Inc., to promote community
   61  awareness and action through educational, economic, and cultural
   62  service activities within this state.
   63         (II) Ten percent shall be distributed to the Delta Research
   64  and Educational Foundation, Inc., solely for the marketing of
   65  the plate.
   66         f. Phi Beta Sigma Fraternity, Inc.
   67         (I) Eighty-five percent shall be distributed to the TMB
   68  Charitable Foundation, Inc., to promote community awareness and
   69  action through educational, economic, and cultural service
   70  activities within this state.
   71         (II) Ten percent shall be distributed to the TMB Charitable
   72  Foundation, Inc., solely for the marketing of the plate.
   73         g. Zeta Phi Beta Sorority, Inc.
   74         (I) Eighty-five percent shall be distributed to the Florida
   75  Pearls, Inc., to promote community awareness and action through
   76  educational, economic, and cultural service activities within
   77  this state.
   78         (II) Ten percent shall be distributed to the Florida
   79  Pearls, Inc., solely for the marketing of the plate.
   80         h. Sigma Gamma Rho Sorority, Inc.
   81         (I) Eighty-five percent shall be distributed to the Sigma
   82  Gamma Rho Sorority National Education Fund, Inc., to promote
   83  community awareness and action through educational, economic,
   84  and cultural service activities within this state.
   85         (II) Ten percent shall be distributed to the Sigma Gamma
   86  Rho Sorority National Education Fund, Inc., solely for the
   87  marketing of the plate.
   88         i. Iota Phi Theta Fraternity, Inc.
   89         (I) Eighty-five percent shall be distributed to the
   90  National Iota Foundation, Inc., to promote community awareness
   91  and action through educational, economic, and cultural service
   92  activities within this state.
   93         (II) Ten percent shall be distributed to the National Iota
   94  Foundation, Inc., solely for the marketing of the plate.
   95  
   96  License plates created pursuant to this subsection shall have
   97  their plate sales combined for the purpose of meeting the
   98  minimum license plate sales threshold in s. 320.08056(8)(a) and
   99  for determining the license plate limit in s. 320.08053(3)(b).
  100  License plates created pursuant to this subsection must be
  101  ordered directly from the department.
