1 A bill to be entitled
2 An act relating to human trafficking prevention;
3 amending s. 488.01, F.S.; requiring certain commercial
4 driver schools to offer as part of their curriculum
5 either a human trafficking prevention course
6 administered by the Department of Law Enforcement or
7 by a certain organization or certain industry-specific
8 training; requiring the Department of Law Enforcement
9 to adopt rules by a specified date to develop and
10 implement the human trafficking prevention course;
11 amending s. 1012.45, F.S.; requiring that a specified
12 amount of time in a school bus driver training program
13 provided by a district school board be allocated to
14 certain industry-specific training; providing an
15 effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Section 488.01, Florida Statutes, is amended to
20 read:
21 488.01 License to engage in business of operating a driver
22 school required.—
23 (1) The Department of Highway Safety and Motor Vehicles
24 shall oversee and license all commercial driver schools except
25 truck driving schools. All commercial truck driving schools
26 shall be required to be licensed pursuant to chapter 1005, and
27 additionally, shall be subject to subsection (2) and the
28 provisions of ss. 488.04 and 488.05. No person, group,
29 organization, institution, business entity, or corporate entity
30 may engage in the business of operating a driver school without
31 first obtaining a license therefor from the Department of
32 Highway Safety and Motor Vehicles pursuant to this chapter or
33 from the Commission for Independent Education pursuant to
34 chapter 1005.
35 (2) Except for commercial driver schools or curriculum
36 offered only for school bus drivers, all publicly funded
37 commercial driver schools, including all commercial truck
38 driving schools, must offer as part of their curriculum either
39 of the following:
40 (a) A human trafficking prevention course administered by
41 the Department of Law Enforcement or by an organization that is
42 approved by the Department of Law Enforcement to present such a
43 course. The Department of Law Enforcement shall adopt rules to
44 develop and implement the human trafficking prevention course by
45 January 1, 2021.
46 (b) Industry-specific training on the recognition,
47 prevention, and reporting of human trafficking.
48 Section 2. Subsection (4) of section 1012.45, Florida
49 Statutes, is amended to read:
50 1012.45 School bus drivers; requirements and duties.—
51 (4) Each district school board may provide a school bus
52 driver training program and may make this program available to
53 private school bus drivers by contract. If a district school
54 board provides a school bus driver training program, 40 minutes
55 of the program must be allocated to industry-specific training
56 on the recognition, prevention, and reporting of human
57 trafficking.
58 Section 3. This act shall take effect October 1, 2020.
