       Senator Flores moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 205 and 206
    4  insert:
    5         Section 4. Subsection (2) of section 27.51, Florida
    6  Statutes, is amended to read:
    7         27.51 Duties of public defender.—
    8         (2) The court may not appoint the public defender to
    9  represent, even on a temporary basis, any person who is not
   10  indigent. The court, however, may appoint private counsel in
   11  capital cases as provided in ss. 27.40 and 27.5303. The public
   12  defender may not be appointed to simultaneously represent any
   13  person in any case where private counsel has been obtained.

   16  And the title is amended as follows:
   17         Delete lines 30 - 33
   18  and insert:
   19         provided by law; amending s. 27.51, F.S.; specifying
   20         additional circumstances under which a public defender
   21         may not be appointed to represent a person; revising
   22         the duties of the public defender regarding the
   23         handling of appeals to conform to changes made by the
   24         act; amending s. 27.511, F.S.; revising the duties of
   25         the office of criminal conflict and civil regional
   26         counsel regarding the handling of appeals to
