       Senator Book moved the following:
       
    1         Senate Substitute for Amendment (546622) (with title
    2  amendment)
    3  
    4         Between lines 24 and 25
    5  insert:
    6         (3) The Legislature does not intend for the application of
    7  this section to supersede any prohibition against the use of
    8  fireworks contained within a legally executed and properly
    9  recorded declaration of covenants or covenant running with the
   10  land of any homeowners’ association pursuant to chapter 720.
   11  However, a homeowners’ association, through a board of
   12  directors, may not promulgate rules that attempt to abrogate a
   13  homeowner’s right to use fireworks during a designated holiday
   14  or under general law.

   17  And the title is amended as follows:
   18         Delete line 6
   19  and insert:
   20         construction; providing legislative intent;
   21         prohibiting homeowners’ associations from promulgating
   22         certain rules or regulations; providing an effective
   23         date.
