1 A bill to be entitled
2 An act relating to fireworks; creating s. 791.08,
3 F.S.; defining the term “designated holiday”;
4 providing an exemption for the use of fireworks solely
5 and exclusively during a designated holiday; requiring
6 the Division of the State Fire Marshal of the
7 Department of Financial Services to adopt certain
8 rules; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 791.08, Florida Statutes, is created to
13 read:
14 791.08 Use during designated holidays; exemption.—
15 (1) As used in this section, the term “designated holiday”
16 means:
17 (a) Memorial Day, the last Monday in May;
18 (b) Independence Day, July 4; or
19 (c) New Year’s Eve, December 31.
20 (2) This chapter does not prohibit the use of fireworks
21 solely and exclusively during a designated holiday. Such use
22 must be governed entirely by rules the division shall adopt. The
23 rules must prescribe such use in the same manner as under rules
24 adopted under s. 791.07.
25 Section 2. This act shall take effect upon becoming a law.
