(Brandes) recommended the following:

4 insert:
5 Section 2. Subsection (4) of section 27.51, Florida
6 Statutes, is amended to read:
7 27.51 Duties of public defender.—
8 (4) The public defender for the judicial circuit specified
9 in this subsection shall, after the record on appeal is
10 transmitted to the appellate court by the office of the public
11 defender which handled the trial and if requested by any public
12 defender within the indicated appellate district, handle all
13 circuit court and county court criminal appeals within the state
14 courts system and any authorized appeals to the federal courts
15 required of the official making such request:
16 (a) Public defender of the second judicial circuit, on
17 behalf of any public defender within the district comprising the
18 First District Court of Appeal.
19 (b) Public defender of the tenth judicial circuit, on
20 behalf of any public defender within the district comprising the
21 Second District Court of Appeal.
22 (c) Public defender of the eleventh judicial circuit, on
23 behalf of any public defender within the district comprising the
24 Third District Court of Appeal.
25 (d) Public defender of the fifteenth judicial circuit, on
26 behalf of any public defender within the district comprising the
27 Fourth District Court of Appeal.
28 (e) Public defender of the seventh judicial circuit, on
29 behalf of any public defender within the district comprising the
30 Fifth District Court of Appeal.
31 Section 3. Subsection (8) of section 27.511, Florida
32 Statutes, is amended to read:
33 27.511 Offices of criminal conflict and civil regional
34 counsel; legislative intent; qualifications; appointment;
35 duties.—
36 (8) The public defender for the judicial circuit specified
37 in s. 27.51(4) shall, after the record on appeal is transmitted
38 to the appellate court by the office of criminal conflict and
39 civil regional counsel which handled the trial and if requested
40 by the regional counsel for the indicated appellate district,
41 handle all circuit court and county court criminal appeals
42 authorized pursuant to paragraph (5)(f) within the state courts
43 system and any authorized appeals to the federal courts required
44 of the official making the request. If the public defender
45 certifies to the court that the public defender has a conflict
46 consistent with the criteria prescribed in s. 27.5303 and moves
47 to withdraw, the regional counsel shall handle the appeal,
48 unless the regional counsel has a conflict, in which case the
49 court shall appoint private counsel pursuant to s. 27.40.
