       The Committee on Rules (Perry) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Paragraph (j) is added to subsection (1) of
    6  section 119.07, Florida Statutes, to read:
    7         119.07 Inspection and copying of records; photographing
    8  public records; fees; exemptions.—
    9         (1)(j) After receiving a request to inspect or copy a
   10  record, an agency may not respond to that request by filing an
   11  action for declaratory relief against the requester to determine
   12  the status of those records as exempt or confidential from this
   13  chapter.
   14         Section 2. This act shall take effect July 1, 2020.

   19  and insert:
   20                        A bill to be entitled                      
   21         An act relating to public records; amending s. 119.07,
   22         F.S.; prohibiting an agency that receives a request to
   23         inspect or copy a record from responding to such
   24         request by filing an action for declaratory relief
   25         against the requester; providing an effective date.
