1 A bill to be entitled
2 An act relating to driver licenses; amending s.
3 322.08, F.S.; requiring application forms for
4 original, renewal, and replacement driver licenses and
5 identification cards to include language allowing a
6 voluntary contribution to the Live Like Bella
7 Childhood Cancer Foundation; amending s. 322.14, F.S.;
8 authorizing a person with specified disabilities to
9 have the capital letter “D” exhibited on his or her
10 driver license under certain circumstances; providing
11 requirements for the placement of such letter on a
12 person’s driver license; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Subsection (8) of section 322.08, Florida
17 Statutes, is amended to read:
18 322.08 Application for license; requirements for license
19 and identification card forms.—
20 (8) The application form for an original, renewal, or
21 replacement driver license or identification card must include
22 language permitting the following:
23 (a) A voluntary contribution of $1 per applicant, which
24 contribution shall be deposited into the Health Care Trust Fund
25 for organ and tissue donor education and for maintaining the
26 organ and tissue donor registry.
27 (b) A voluntary contribution of $1 per applicant, which
28 shall be distributed to the Florida Council of the Blind.
29 (c) A voluntary contribution of $2 per applicant, which
30 shall be distributed to the Hearing Research Institute,
31 Incorporated.
32 (d) A voluntary contribution of $1 per applicant, which
33 shall be distributed to the Juvenile Diabetes Foundation
34 International.
35 (e) A voluntary contribution of $1 per applicant, which
36 shall be distributed to the Children’s Hearing Help Fund.
37 (f) A voluntary contribution of $1 per applicant, which
38 shall be distributed to Family First, a nonprofit organization.
39 (g) A voluntary contribution of $1 per applicant to Stop
40 Heart Disease, which shall be distributed to the Florida Heart
41 Research Institute, a nonprofit organization.
42 (h) A voluntary contribution of $1 per applicant to Senior
43 Vision Services, which shall be distributed to the Florida
44 Association of Agencies Serving the Blind, Inc., a not-for
45 profit organization.
46 (i) A voluntary contribution of $1 per applicant for
47 services for persons with developmental disabilities, which
48 shall be distributed to The Arc of Florida.
49 (j) A voluntary contribution of $1 to the Ronald McDonald
50 House, which shall be distributed each month to Ronald McDonald
51 House Charities of Tampa Bay, Inc.
52 (k) Notwithstanding s. 322.081, a voluntary contribution of
53 $1 per applicant, which shall be distributed to the League
54 Against Cancer/La Liga Contra el Cancer, a not-for-profit
55 organization.
56 (l) A voluntary contribution of $1 per applicant to Prevent
57 Child Sexual Abuse, which shall be distributed to Lauren’s Kids,
58 Inc., a nonprofit organization.
59 (m) A voluntary contribution of $1 per applicant, which
60 shall be distributed to Prevent Blindness Florida, a not-for
61 profit organization, to prevent blindness and preserve the sight
62 of the residents of this state.
63 (n) Notwithstanding s. 322.081, a voluntary contribution of
64 $1 per applicant to the state homes for veterans, to be
65 distributed on a quarterly basis by the department to the
66 Operations and Maintenance Trust Fund within the Department of
67 Veterans’ Affairs.
68 (o) A voluntary contribution of $1 per applicant to the
69 Disabled American Veterans, Department of Florida, which shall
70 be distributed quarterly to Disabled American Veterans,
71 Department of Florida, a nonprofit organization.
72 (p) A voluntary contribution of $1 per applicant for Autism
73 Services and Supports, which shall be distributed to Achievement
74 and Rehabilitation Centers, Inc., Autism Services Fund.
75 (q) A voluntary contribution of $1 per applicant to Support
76 Our Troops, which shall be distributed to Support Our Troops,
77 Inc., a Florida not-for-profit organization.
78 (r) Notwithstanding s. 322.081, a voluntary contribution of
79 $1 per applicant to aid the homeless. Contributions made
80 pursuant to this paragraph shall be deposited into the Grants
81 and Donations Trust Fund of the Department of Children and
82 Families and used by the State Office on Homelessness to
83 supplement grants made under s. 420.622(4) and (5), provide
84 information to the public about homelessness in the state, and
85 provide literature for homeless persons seeking assistance.
86 (s) A voluntary contribution of $1 or more per applicant to
87 End Breast Cancer, which shall be distributed to the Florida
88 Breast Cancer Foundation.
89 (t) A voluntary contribution of $1 or more per applicant to
90 Childhood Cancer Care, which shall be distributed to the Live
91 Like Bella Childhood Cancer Foundation.

93 A statement providing an explanation of the purpose of the trust
94 funds shall also be included. For the purpose of applying the
95 service charge provided under s. 215.20, contributions received
96 under paragraphs (b)-(t) (b)-(s) are not income of a revenue
97 nature.
98 Section 2. Paragraph (f) is added to subsection (1) of
99 section 322.14, Florida Statutes, to read:
100 322.14 Licenses issued to drivers.—
101 (1)
102 (f)1. Upon request by a person who has a developmental
103 disability, or by a parent or guardian of a child or ward who
104 has a developmental disability, the capital letter “D” shall be
105 exhibited on the driver license of a person who has a
106 developmental disability, as defined in s. 393.063, if the
107 person, or his or her parent or legal guardian, presents
108 sufficient proof that the person has been diagnosed with a
109 developmental disability by a physician licensed under chapter
110 458 or chapter 459 as determined by the department.
111 2. Until a person’s driver license is next renewed, the
112 person, or his or her parent or legal guardian, may have the
113 capital letter “D” added to his or her license upon the
114 surrender of his or her current license and presentation of
115 sufficient proof that the person has been diagnosed with a
116 developmental disability by a physician licensed under chapter
117 458 or chapter 459 as determined by the department. If the
118 applicant is not conducting any other transaction affecting the
119 driver license, a replacement license may be issued with the
120 capital letter “D” without payment of the fee required in s.
121 322.21(1)(e).
122 Section 3. This act shall take effect October 1, 2020.
