       The Committee on Banking and Insurance (Rouson) recommended the
       following:
       
    1         Senate Amendment to Amendment (142964) (with title
    2  amendment)

    4         Delete line 539
    5  and insert:
    6         (6)The Florida Digital Service and the enterprise, as
    7  defined in s. 282.0041, shall take necessary steps to protect
    8  any personal identifying information under their control. A
    9  person who knowingly obtains, discloses, or uses personal
   10  identifying information under the control of the Florida Digital
   11  Service or the enterprise is liable to the individual to whom
   12  the information pertains, who may bring a civil action. The
   13  court may award actual damages, but not less than liquidated
   14  damages in the amount of $2,500.
