    1                        A bill to be entitled                      
    2         An act relating to three-dimensional printed firearms;
    3         creating s. 790.224, F.S.; defining the term “3D
    4         printed firearm”; prohibiting a person from printing,
    5         transferring, importing into this state, distributing,
    6         selling, possessing, or giving to another person
    7         certain 3D-printed firearms as of a specified date;
    8         providing criminal penalties; requiring persons in
    9         possession of such firearms to relinquish them to a
   10         law enforcement agency or to the Department of Law
   11         Enforcement or to destroy them before the prohibition
   12         takes effect; requiring a law enforcement agency or
   13         the department to destroy any relinquished firearms
   14         within a specified timeframe; providing for the future
   15         expiration of certain provisions; providing an
   16         effective date.
   18  Be It Enacted by the Legislature of the State of Florida:
   20         Section 1. Section 790.224, Florida Statutes, is created to
   21  read:
   22         790.2243D-printed firearms.—
   23         (1) As used in this section, the term “3D-printed firearm
   24  means a firearm that is created using a three-dimensional
   25  printer or an additive manufacturing process, or a similar
   26  device or process, and that is capable of firing one or more
   27  projectiles.
   28         (2)On or after January 1, 2021, a person may not print,
   29  transfer, import into this state, distribute, sell, possess, or
   30  give to another person a 3D-printed firearm that:
   31         (a)Is created using:
   32         1.Polyethylene terephthalate;
   33         2. Polycarbonate;
   34         3. Polylactic acid; or
   35         4. Acrylonitrile butadiene styrene; and
   36         (b)Does not contain at least 4 ounces of a metal
   37  detectable by metal detectors used for security checks.
   38         (3) A person who violates subsection (2) commits a felony
   39  of the third degree, punishable as provided in s. 775.082, s.
   40  775.083, or s. 775.084.
   41         (4)(a)A person who owns or is in possession of a 3D
   42  printed firearm as described in subsection (2) shall:
   43         1.Relinquish the firearm to a law enforcement agency, as
   44  defined in s. 934.02, or to the Department of Law Enforcement,
   45  in which case the law enforcement agency or the department must
   46  destroy the firearm within 120 days after the relinquishment; or
   47         2. Destroy the firearm.
   48         (b) This subsection expires on December 31, 2020.
   49         Section 2. This act shall take effect July 1, 2020.
