    1                        A bill to be entitled                      
    2         An act relating to prohibited acts by health care
    3         practitioners; amending s. 456.072, F.S.; authorizing
    4         disciplinary action to be enforced by the Department
    5         of Health for the use of specified names or titles
    6         without a valid license or certification to practice
    7         as such; providing a definition; providing an
    8         effective date.
    9          
   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Paragraph (pp) is added to subsection (1) of
   13  section 456.072, Florida Statutes, to read:
   14         456.072 Grounds for discipline; penalties; enforcement.—
   15         (1) The following acts shall constitute grounds for which
   16  the disciplinary actions specified in subsection (2) may be
   17  taken:
   18         (pp)1.Knowingly using the name or title “physician,”
   19  “surgeon,” “medical doctor,” “doctor of osteopathy,” “M.D.,”
   20  “anesthesiologist,” “cardiologist,” “dermatologist,”
   21  “endocrinologist,” “gastroenterologist,” “general practitioner,”
   22  “gynecologist,” “hematologist,” “hospitalist,” “internist,”
   23  “interventional pain medicine physician,” “laryngologist,”
   24  “nephrologist,” “neurologist,” “obstetrician,” “oncologist,”
   25  “ophthalmologist,” “orthopedic surgeon,” “orthopedist,”
   26  “osteopath,” “otologist,” “otolaryngologist,”
   27  “otorhinolaryngologist,” “pathologist,” “pediatrician,”
   28  “podiatrist,” “primary care physician,” “proctologist,”
   29  “psychiatrist,” “radiologist,” “rheumatologist,” “rhinologist,”
   30  or “urologist,” or any other words, letters, abbreviations, or
   31  insignia indicating or implying that he or she is authorized by
   32  chapter 458, chapter 459, or chapter 461 to practice as such. If
   33  the department finds any person guilty of the grounds set forth
   34  in this paragraph, it may enter an order imposing one or more of
   35  the penalties provided in subsection (2).
   36         2.For purposes of this paragraph, “anesthesiologist” has
   37  the same meaning as provided in s. 458.3475 or s. 459.023.
   38         Section 2. This act shall take effect upon becoming a law.
