       The Committee on Rules (Brandes) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete line 27
    4  and insert:
    5         Section 2. Effective July 1, 2020, subsection (1) of
    6  section 903.286, Florida Statutes, is amended to read:
    7         903.286 Return of cash bond; requirement to withhold unpaid
    8  fines, fees, court costs; cash bond forms.—
    9         (1) Notwithstanding s. 903.31(2), the clerk of the court
   10  shall withhold from the return of a cash bond posted on behalf
   11  of a criminal defendant by a person other than a bail bond agent
   12  licensed pursuant to chapter 648 or an entity that is currently
   13  a tax-exempt organization under s. 501(c) of the Internal
   14  Revenue Code sufficient funds to pay any unpaid costs of
   15  prosecution, costs of representation as provided by ss. 27.52
   16  and 938.29, court fees, court costs, and criminal penalties. If
   17  sufficient funds are not available to pay all unpaid costs of
   18  prosecution, costs of representation as provided by ss. 27.52
   19  and 938.29, court fees, court costs, and criminal penalties, the
   20  clerk of the court shall immediately obtain payment from the
   21  defendant or enroll the defendant in a payment plan pursuant to
   22  s. 28.246.
   23         Section 3. Except as otherwise expressly provided in this
   24  act and except for this section, which shall take effect July 1,
   25  2020, this act shall take effect October 1, 2020.

   28  And the title is amended as follows:
   29         Delete lines 2 - 7
   30  and insert:
   31         An act relating to bail; amending s. 903.133, F.S.;
   32         prohibiting a court from granting bail to specified
   33         offenders pending review following a conviction for an
   34         offense requiring sexual offender or sexual predator
   35         registration if the victim was a minor; amending s.
   36         903.286, F.S.; providing that certain costs and fees
   37         may not be withheld from the return of a cash bond
   38         when such bond is posted by specified tax-exempt
   39         organizations; providing effective dates.
