    1                        A bill to be entitled                      
    2         An act relating to clerks of the court; amending s.
    3         40.29, F.S.; requiring the clerks of court to submit a
    4         request for reimbursement for jury-related costs to
    5         the Florida Clerks of Court Operations Corporation
    6         within specified timeframes; requiring the corporation
    7         to review the requests for reimbursement; requiring
    8         the corporation to submit certain information to the
    9         Justice Administrative Commission; requiring the
   10         commission to review the information and submit a
   11         request for payment to the Chief Financial Officer
   12         under certain circumstances; removing a provision
   13         authorizing the commission to apportion funds among
   14         the counties for certain purposes; providing an
   15         effective date.

   17  Be It Enacted by the Legislature of the State of Florida:
   18  
   19         Section 1. Subsection (5) of section 40.29, Florida
   20  Statutes, is amended to read:
   21         40.29 Payment of due-process costs.—
   22         (5) The Justice Administrative Commission shall provide
   23  funds to the clerks of the court to compensate jurors, to pay
   24  for meals or lodging provided to jurors, and to pay for jury
   25  related personnel costs as provided in this section. Each clerk
   26  of the court shall submit a request for reimbursement forward to
   27  the Florida Clerks of Court Operations Corporation within 20
   28  days after each quarter attesting to the clerk’s actual costs
   29  Justice Administrative Commission a quarterly estimate of funds
   30  necessary to compensate jurors, to and pay for meals or lodging
   31  provided to jurors, and to pay for jury-related personnel costs
   32  during the upcoming quarter. The Florida Clerks of Court
   33  Operations Corporation shall review the request for
   34  reimbursement to ensure that the costs are reasonably and
   35  directly related to jury management. The Florida Clerks of Court
   36  Operations Corporation shall forward to the Justice
   37  Administrative Commission a quarterly estimate of the amount
   38  necessary to reimburse each clerk of the court for its personnel
   39  and other costs related to jury management unless the total
   40  request for reimbursement by the clerks exceeds the quarterly
   41  funds available to the Justice Administrative Commission, in
   42  which case the Florida Clerks of Court Operations Corporation
   43  shall adjust the cumulative total to match the available funds
   44  before submitting the request to the Justice Administrative
   45  Commission. Upon receipt of each request for reimbursement such
   46  estimates, the Justice Administrative Commission shall review
   47  determine the amount deemed necessary for payment to the clerks
   48  of the court for the most recently completed during the upcoming
   49  quarter, determine if the total payment amount is available, and
   50  submit a request for payment to the Chief Financial Officer. If
   51  the Justice Administrative Commission believes that the amount
   52  appropriated by the Legislature is insufficient to meet such
   53  costs during the remaining part of the state fiscal year, the
   54  commission may apportion the funds appropriated in the General
   55  Appropriations Act for those purposes among the several
   56  counties, basing the apportionment upon the amount expended for
   57  such purposes in each county during the prior fiscal year, in
   58  which case, the Chief Financial Officer shall issue the
   59  appropriate apportioned amount by warrant to each county. The
   60  clerks of the court are responsible for any compensation to
   61  jurors, for payments for meals or lodging provided to jurors,
   62  and for jury-related personnel costs that exceed the funding
   63  provided in the General Appropriations Act for these purposes.
   64         Section 2. This act shall take effect July 1, 2020.
