The Committee on Health Policy (Pizzo) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Paragraph (b) of subsection (11) of section
6 381.0041, Florida Statutes, is amended to read:
7 381.0041 Donation and transfer of human tissue; testing
8 requirements.—
9 (11)
10 (b) Any person who has human immunodeficiency virus
11 infection, who knows he or she is infected with human
12 immunodeficiency virus, and who has been informed that he or she
13 may communicate this disease by donating blood, plasma, organs,
14 skin, or other human tissue who donates blood, plasma, organs,
15 skin, or other human tissue for use in another person commits is
16 guilty of a felony of the third degree, punishable as provided
17 in s. 775.082, s. 775.083, or s. 775.084. This paragraph does
18 not apply if the donation is made specifically for a recipient
19 who is infected with human immunodeficiency virus and knows that
20 the donor is infected with human immunodeficiency virus.
21 Section 2. This act shall take effect July 1, 2020.

24 And the title is amended as follows:
25 Delete everything before the enacting clause
26 and insert:
27 A bill to be entitled
28 An act relating to donation and transfer of human
29 tissue; amending s. 381.0041, F.S.; providing that it
30 is a felony for certain persons who are infected with
31 human immunodeficiency virus to donate human tissue
32 for use in another person, with an exception;
33 providing an effective date.
