       The Committee on Banking and Insurance (Brandes) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 17 - 44
    4  and insert:
    5         (4) In an award of attorney fees under this section for a
    6  claim arising under a property insurance policy, a strong
    7  presumption is created that a lodestar fee is sufficient and
    8  reasonable. Such presumption may be rebutted only in a rare and
    9  exceptional circumstance with evidence that competent counsel
   10  could not be retained in a reasonable manner.
