    1                        A bill to be entitled                      
    2         An act relating to a review under the Open Government
    3         Sunset Review Act; amending s. 339.55, F.S., which
    4         provides an exemption from public records requirements
    5         for financial information of a private entity
    6         applicant which the Department of Transportation
    7         requires as part of an application process for loans
    8         or credit enhancements from the state-funded
    9         infrastructure bank; removing the scheduled repeal of
   10         the exemption; providing an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (10) of section 339.55, Florida
   15  Statutes, is amended to read:
   16         339.55 State-funded infrastructure bank.—
   17         (10)(a) Financial information of a private entity applicant
   18  which the department requires as part of the application process
   19  for loans or credit enhancements from the state-funded
   20  infrastructure bank is exempt from s. 119.07(1) and s. 24(a),
   21  Art. I of the State Constitution. This exemption does not apply
   22  to records of an applicant who is in default of a loan issued
   23  under this section. As used in this subsection, the term
   24  “financial information” means any business plan, pro forma
   25  statement, account balance, operating income or revenue, asset
   26  value, or debt of the applicant.
   27         (b) This subsection is subject to the Open Government
   28  Sunset Review Act in accordance with s. 119.15 and shall stand
   29  repealed on October 2, 2021, unless reviewed and saved from
   30  repeal through reenactment by the Legislature.
   31         Section 2. This act shall take effect October 1, 2021.
