       Senator Diaz moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 119 - 152
    4  and insert:
    5         (a)A plan for the technological and resource design,
    6  curriculum, classroom operation, school or district management,
    7  privacy protection and teacher professional development, and at
    8  least weekly progress monitoring of real-time student
    9  performance in innovative blended learning programs.
   10         (b)A plan to reduce achievement gaps through innovative
   11  blended learning.
   12         (c)A requirement that distance learning will always be at
   13  the choosing of the student or the student’s parent or guardian
   14  and that a family will never be coerced to choose distance
   15  learning.
   16         (d)A requirement that a participating classroom may not be
   17  fully virtual such that at least two-thirds of the students in a
   18  class must be present for in-person learning on any regularly
   19  scheduled school day.
   20         (e)A requirement that any struggling student who is
   21  participating in this program and who, according to progress
   22  monitoring data, is on pace to learn less than a year’s content
   23  in a year’s time must return to learning in person.
   24         (f)A requirement that any student can choose to switch
   25  learning modalities, in person or distance, on any given day,
   26  without notice and therefore a seat must always be available for
   27  every student registered to take any participating course.
   28         (g)A requirement that the applicant provide all requested
   29  student-level data from participating schools, including, as
   30  necessary, benchmark historical data for up to the prior 3
   31  school years, to the department upon request.
   32         (5)Applications may be considered only for innovative
   33  blended learning programs.
   34         (6)The Commissioner of Education shall select applicants
   35  to participate in the program.
   36         (7)Districts and schools may not begin approved innovative
   37  blended learning programs until October
