       Senator Brandes moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 26 - 35
    4  and insert:
    5  through (106), respectively, and present subsections (56) and
    6  (62) are amended, and a new subsection (38) is added to that
    7  section, to read:
    8         316.003 Definitions.—The following words and phrases, when
    9  used in this chapter, shall have the meanings respectively
   10  ascribed to them in this section, except where the context
   11  otherwise requires:
   12         (38)LOW-SPEED AUTONOMOUS DELIVERY VEHICLE.—A fully
   13  autonomous vehicle that meets the definition of a low-speed
   14  vehicle in 49 C.F.R. s. 571.3 and is not designed for, or
   15  capable of, human occupancy.
   16         (57)(56) PERSONAL DELIVERY DEVICE.—An electrically powered
   17  device that:
   18         (a) Is operated on sidewalks and crosswalks and intended
   19  primarily for transporting property;
   20         (b) Has a weight that does not exceed the maximum weight
   21  established by Department of Transportation rule Weighs less
   22  than 80 pounds, excluding cargo;
   23         (c) Has a maximum speed of 10 miles per hour; and
   24         (d) Is equipped with technology to allow for operation of
   25  the device with or without the active control or monitoring of a
   26  natural person.

   28  A personal delivery device is not considered a vehicle unless
   29  expressly defined by law as a vehicle. A mobile carrier is not
   30  considered a personal delivery device. The Department of
   31  Transportation may adopt rules to implement this subsection.
