    1                        A bill to be entitled                      
    2         An act relating to personal protective equipment;
    3         amending s. 252.35, F.S.; requiring the Division of
    4         Emergency Management to complete an inventory of
    5         personal protective equipment; requiring the division
    6         to take certain action to ensure the availability of
    7         personal protective equipment during a declared
    8         emergency caused by an infectious or communicable
    9         disease; requiring that such equipment be available
   10         for purchase at a certain cost by specified persons
   11         and entities; prohibiting such equipment from being
   12         resold at certain prices; providing an effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Paragraph (z) is added to subsection (2) of
   17  section 252.35, Florida Statutes, to read:
   18         252.35 Emergency management powers; Division of Emergency
   19  Management.—
   20         (2) The division is responsible for carrying out the
   21  provisions of ss. 252.31-252.90. In performing its duties, the
   22  division shall:
   23         (z) Complete an inventory of personal protective equipment,
   24  such as respirators, gloves, gowns, and masks, that are used to
   25  protect the wearer from illness during a declared emergency
   26  caused by an infectious or communicable disease, which are held
   27  in reserve. The division must plan for and procure personal
   28  protective equipment, or have sufficient standby logistic
   29  contracts in place that will ensure the availability of personal
   30  protective equipment, in the event of a declared emergency
   31  caused by an infectious or communicable disease. Such personal
   32  protective equipment shall be available for purchase by a health
   33  care practitioner as defined in s. 456.001 or an employer of a
   34  health care practitioner at the cost procured or negotiated by
   35  the division and may not be resold at a price that exceeds the
   36  purchase price.
   37         Section 2. This act shall take effect July 1, 2021.
