    1                        A bill to be entitled                      
    2         An act relating to costs of incarceration; amending s.
    3         960.293, F.S.; providing that only offenders convicted
    4         of capital or life felonies are liable for a
    5         liquidated damage amount for incarceration and other
    6         correctional costs; removing provisions specifying a
    7         fixed daily amount for an offender’s liability for
    8         incarceration costs and other correctional costs for
    9         offenders convicted of certain offenses; providing an
   10         effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (2) of section 960.293, Florida
   15  Statutes, is amended to read:
   16         960.293 Determination of damages and losses.—
   17         (2) Upon conviction, a convicted offender is liable to the
   18  state and its local subdivisions for damages and losses for
   19  incarceration costs and other correctional costs.
   20         (a)if the conviction is for a capital or life felony, the
   21  convicted offender is liable for incarceration costs and other
   22  correctional costs in the liquidated damage amount of $250,000.
   23         (b)If the conviction is for an offense other than a
   24  capital or life felony, a liquidated damage amount of $50 per
   25  day of the convicted offender’s sentence shall be assessed
   26  against the convicted offender and in favor of the state or its
   27  local subdivisions. Damages shall be based upon the length of
   28  the sentence imposed by the court at the time of sentencing.
   29         Section 2. This act shall take effect July 1, 2021.
