amendment:

On Page: 131             Adds proviso language to the Grants and Aids - 
                         Contracted Drug Treatment / Rehabilitation Programs 
Spec App:  726           appropriation category within DOC Community 
                         Substance Abuse Prevention, Evaluation, and 
                         Treatment Services to establish the minimum 
                         reimbursement rate for community-based treatment 
                         programs at 80 percent.

At the end of existing proviso language, following Specific 
Appropriation 726, INSERT:

From the funds in Specific Appropriation 726, the department shall make 
every effort to ensure 100 percent occupancy in the available contracted 
beds. If at any time during the term of the contract, based on the 
department's inability to place inmates and through no fault of the 
contracted provider, the bed occupancy in a community-based treatment 
program falls below 80 percent, the contracted provider shall be paid 
for 80 percent of the contracted available beds until the occupancy 
percentage has returned to 80 percent or higher. Once the occupancy rate 
exceeds 80 percent, the contractor shall be paid for the actual 
percentage of occupied beds up to the maximum available.
