    2         An act relating to the Resilient Florida Trust Fund;
    3         creating s. 380.0935, F.S.; creating the Resilient
    4         Florida Trust Fund within the Department of
    5         Environmental Protection; providing for the purpose of
    6         the fund; providing for future review and termination
    7         or re-creation of the fund; providing a contingent
    8         effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Effective July 1, 2021, section 380.0935,
   13  Florida Statutes, is created to read:
   14         380.0935 Resilient Florida Trust Fund.—
   15         (1)The Resilient Florida Trust Fund is created within the
   16  Department of Environmental Protection.
   17         (2)Moneys deposited in the fund are available as a funding
   18  source for the department for the Resilient Florida Grant
   19  Program and the Statewide Flooding and Sea-Level Rise Resilience
   20  Plan, including costs to operate the grant program, to develop
   21  the plan, and to provide grants to regional resilience
   22  coalitions pursuant to s. 380.093. The department may also use
   23  moneys deposited in the fund for administrative and operational
   24  costs of the Florida Flood Hub for Applied Research and
   25  Innovation pursuant to s. 380.0933 and coastal resilience
   26  initiatives.
   27         (3)In accordance with s. 19(f)(2), Art. III of the State
   28  Constitution, the Resilient Florida Trust Fund shall, unless
   29  terminated sooner, be terminated on July 1, 2025. Before its
   30  scheduled termination, the fund shall be reviewed as provided in
   31  s. 215.3206(1) and (2).
   32         Section 2. Except as otherwise expressly provided in this
   33  act, this act shall take effect on the same date that SB 1954 or
   34  similar legislation takes effect, if such legislation is adopted
   35  in the same legislative session or an extension thereof and
   36  becomes a law.
