    1                        A bill to be entitled                      
    2         An act relating to product evaluation; amending s.
    3         553.842, F.S.; requiring the Florida Building
    4         Commission to approve a specified evaluation entity;
    5         providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Paragraph (a) of subsection (8) of section
   10  553.842, Florida Statutes, is amended to read:
   11         553.842 Product evaluation and approval.—
   12         (8) The commission may adopt rules to approve the following
   13  types of entities that produce information on which product
   14  approvals are based. All of the following entities, including
   15  engineers and architects, must comply with a nationally
   16  recognized standard demonstrating independence or no conflict of
   17  interest:
   18         (a) Evaluation entities approved pursuant to this
   19  paragraph. The commission shall specifically approve the
   20  National Evaluation Service, the International Association of
   21  Plumbing and Mechanical Officials Evaluation Service, the
   22  International Code Council Evaluation Services, Underwriters
   23  Laboratories, LLC, Intertek Testing Services NA, Inc., and the
   24  Miami-Dade County Building Code Compliance Office Product
   25  Control Division, and NEMO ETC, LLC. Architects and engineers
   26  licensed in this state are also approved to conduct product
   27  evaluations as provided in subsection (5).
   28         Section 2. This act shall take effect July 1, 2021.
